Can I publish a children's story my mom wrote?

A few years ago my Mother passed away and I am just now going through some old note books and papers. I came across a couple of children's stories she wrote that I think are pretty good. I'd like to see if they could get one published because it was something she always dreamed about. My question is how would I do it? Can I publish something under her name even though she's passed away?

    A favorite example of mine would be a children's story that was written for a family newsletter published by the children that was then brought to full publication many years later.

    Why not? John Kennedy Toole's mother had his stuff published posthumously. I guess you'd edit and clean the text, learn to draft a query letter, find a literary agent and off you go!

    Assuming your mother did not pass the copyright to someone else under a will, it is likely that it passed to you/your siblings at her death, so you would be allowed to publish it. You can contact Washington Lawyers for the Arts and make an appointment to speak to an IP/Arts lawyer about this, for small suggested donation ($20). www.TheWLA.org. If you're outside Washington, search for your local volunteer lawyers for the arts on Google or contact your state's bar association.
