  1 0 Be fruitful and multiply! Fruits are ovaries. They have seeds in them, or meant to have seeds in them in the wild. Cucumbers and tomatoes are fruits. The question of whether the tomato is a fruit or a vegetable found its way into the United States Supreme Court in 1893. The court ruled unanimously in Nix v. Hedden that a tomato is correctly identified as, and thus taxed as, a vegetable, for the purposes of the Tariff of 1883 on imported produce. Which is more of a culinary term than a botanical term.   1 0 Yes, legally they are considered a vegetable. For this reason, they serve a lot of onions in jail food. The law states that inmates must be served x amount of vegetables per day. Onions are the cheapest way to get to x.
