Go get a lawyer. Ask around and find one that suits you. This law firm that specializes in DUI cases helped reduce the sentences of more than one person that I know. There is a lot of good information on their site, and even if you choose not to retain their services, they can answer some of your questions for you. A .1 BAC is not terribly high, so depending on your circumstances, it is likely you'll be convicted on lesser charges.

Then, when you get your license back, DO NOT DRINK AND DRIVE EVER AGAIN.

absolutely get a lawyer, public defenders are crap plus there are a lot of other things going on that you will need a lawyer for.

Getting arrested (not convicted) for a DUI means that you will get your license automatically revoked. To stop this, your lawyer will need to schedule a hearing with the DOL.

Second, do not get a differed if you can avoid it, a deferred is a one shot option and if you get in trouble while under a differed, you get screwed royally. A good lawyer should get the charges reduced or the entire thing thrown out.

Last, the court is going to demand you get a alcohol evaluation. Do not pick someone from the phone book, have your lawyer recommend someone who does evaluations only (does not run a treatment center) and takes cash. Good lawyers usually keep someone in their back pocket who knows how to type the right evaluation up for you.

bad news, by the time you are done, it is going to run you about 5K.

Like everyone else is saying, *get a lawyer!*

Unfortunately, the best moves you can make to avoid conviction -- besides taking a taxi -- are the things you have to do /before/ you get arrested:

#1, if you have access to a legal insurance plan (such as the ARAG Group plan offered to Microsoft employees), *sign up.* These plans make it much cheaper to hire that lawyer later.

#2, when pulled over, politely refuse to answer questions and do not consent to a search. The implied consent law only requires you to take a blood alcohol test *after* you are arrested, which means until the officer establishes probable cause to arrest you, you can and should refuse to perform field sobriety tests of any kind. Simply tell the officer that you want a lawyer, and if he has probable cause to arrest you, you will gladly submit to testing as per your lawyer's advice.

I've never gotten a DUI (or had to invoke my right to a lawyer on the roadside, for that matter) but I have taken a ration of shit from Canada's immigration authorities over my arrest record. Modern punishment goes far beyond community service, jail and fines. Nowadays, even the most ordinary crimes destroy a person's employability, credit and freedom to travel. Defend yourself with everything you've got.

The rumors are true: if convicted you WILL be denied entry into Canada for a minimum of five years, after which you get to through an incredibly onerous and, unsurprisingly, expensive process to convince some Canadian Minister that you've been rehabilitated.

And personally--as someone who blew a .12 and lost his license for a year in a rural state--I think you should consider sucking it up and taking your medicine. Do a little penance for all the times you drove WASTED and were lucky enough to do no harm. Canada's over-rated anyway.

Well, something you must ask yourself. Was this an isolated incident, or was it bound to happen? In any event, make an informed decision over how to plead at your court date. There is no charge for the initial meeting with an attorney, and you'll probably want to meet with a few to find out what the average cost will be (5 to 7K). Attorneys can not guarantee an outcome, that all depends on the Judge. For the future?? remember DONT DRIVE TO THE DRINK because THERE IS NO LEGAL LIMIT.

Buy a bus pass and get to know your local bus system. And your inability to travel internationally for a year should give you plenty of time to think about the scope of what you just got caught doing.

Get a lawyer. I always recommend Rick Leo, who has his own firm in Bothell, and used to be a public defender* and is a great trial attorney. He just helped a friend of mine in your situation, and she was very happy with the result.

    * Public defenders are usually great criminal & trial lawyers, but are overworked and do not have the time or other resources of private counsel, or of the prosecutor's office. How fair is that?

You will be asked to undergo an alcohol/drug addiction evaluation. Do not go to the cheapest place on the list. The cheap places are outpatient clinics who make their money on rehab clients. They will attempt to convince you that you need rehabilitation. Do not let them. You will also want to lie about any drinking or drugs you've done. Act like the first time you ever drank was in fact when you got the DUI. Specifically, avoid a business called "the Shamrock Group" That is probably the most important time and money saving thing you can do, for starters. Go to all of your court hearings, the DUI victims panel, the drug/alcohol information school. It all feels like Bullshit, but in WA, you will have to jump through the hoops. I took a court appointed lawyer and got the same book thrown at me as a guy with a personal lawyer, so save your money. Also, you won't be allowed into Canada for 5 years after your conviction as a DUI is a felony up there.

The first thing to do is contact an attorney in you area. If you live in the Baltimore Region, you can contact the Law Offices of G. Randolph Rice, Jr., LLC at www.RiceLawMD.com or RiceLawMD@gmail.com, Baltimore's Premier DUI/DWI Defense attorney. There can be serious consequences to a DUI conviction. You want to make sure that you hire a lawyer that practices DUI/DWI Defense work. You don't want to hire a employment lawyer that has handled 2 DUI cases in 20 years. You will find that often. Check out the attorneys that you meet with my visiting your State's Case Search website and search the attorney's name. If you don't see a lot of DUI cases or criminal defense cases, then move on.

GET A LAWYER!!! And FIGHT THIS!! Remember one DUI offence WILL KEEP YOU OUT OF TRAVELING TO CANADA!!

Seriously, I have one from 12 years ago and was turned away from the border last summer.

You HAVE to get this dropped.
