I did file a complaint with the WA State Insurance Commissioner and they have already sent a letter on my behalf to the insurance company. Thanks!

The answers you've gotten already are great. Here's another: if you've got a bundle of items to "find homes" for, organize a kid-stuff swap with friends who also have children. Bring gently used toys, art supplies, and clothing--things that your kids are ready to offer up--and you cultivate the idea, while your kids are young, that these items have value and are reusable. Whatever is left over can be donated to schools, Goodwill, etc.

Thanks for your response, Ozchick. I just sent them a fax today and asked for their answer in writing. We'll see what happens.

Re: how they found out about my other injury -- I'm sure I just offered information when they asked me. I got calls from both sides: mine and the other person's insurance agents. Up until the accident, my neck had at least been allowing me to practice and teach yoga, which is what I do for a living. Would it have been legal for me to say nothing about that other whiplash incident? I wasn't trying to hide anything from anyone because there didn't seem like any reason to...

I am considering sending a note saying that I respectfully deny their request to read my medical records.

Thanks for your response, Griffin. Here's the wrinkle: I used my own Allstate Personal Injury Plan on my own car insurance so I wouldn't have to shell out all my own money for treatment (I didn't have the $ to pay as I went and then have to wait for reimbursements).

At the end of my treatment, I let my insurance contact know that it was finished. That gave them the go-ahead to contact the other agent (representing the person who caused the accident) and say, "now you owe us X dollars for the treatment". My folks were reimbursed by the other agency.

What I am now asking for is the "settlement" (money due to me personally for inconvenience and pain during a year of treatments). Legally, you can ask for 1-3 times the amount that was shelled out for your treatment, and then I assume it becomes a haggling match. I am confused as to why they want records on a previous accident because "settlement" is based on this particular accident.
