  • In Washington, is there some legal preference given to one gender with respect to maintenance?
    Dominik_musafia_sm_small

Washington’s law on spousal maintenance is RCW 26.09.090 and it can be found at this link: http://apps.leg.wa.gov/RCW/default.aspx?cite=26.09.090 . If you check the link you’ll see the statute is gender-neutral. The statute sets out six factors for consideration, and leaves the possibility open to consider other factors not mentioned; however, as is mentioned below, the need -- and the ability to pay -- are very important.

Judges have a great deal of discretion on whether, and how much, spousal maintenance (alimony) will be awarded which always makes this a tricky issue to litigate.

  • What will make the state change a parenting plan?
    Dominik_musafia_sm_small

In some circumstances one parent can unilaterally start an action to modify a parenting plan. For more information on modification you should consider RCW 26.09.260 found at this link: http://apps.leg.wa.gov/RCW/default.aspx?cite=26.09.260.

Also, if one of the parents wants to move out of the area this may result in a need to change the parenting plan. Parenting plans typically have a summary of the relocation statutes contained within them. The statutes on the subject begin with the ‘Notice Requirement’ RCW 26.09.430 found at this link: http://apps.leg.wa.gov/RCW/default.aspx?cite=26.09.430.
